6.a 2024 Paying Agent Agreement

 

Resolution appointing U.S. Bank Trust Company, National Association of St. Paul, Minnesota, to serve as Paying Agent, Bond Registrar, and Transfer Agent, approving the Paying Agent and Bond Registrar and Transfer Agent Agreement and authorizing the execution of the Agreement.

Comment:

This resolution provides final authorization for US Bank of St Paul, Minnesota to act as paying agent for the City of Iowa City in regard to the issuance of $10,140,000 General Obligation Bonds, series 2024.

6.b 2024 Bond Authorization Resolution

 

Resolution Authorizing and Providing for the Issuance of $10,140,000 General Obligation Bonds, Series 2024, and Levying a Tax to Pay Said Bonds; Approval of the Tax Exemption Certificate and Continuing Disclosure Certificate.

Comment:

This resolution approves the tax exemption certificate, the continuing disclosure certificate and authorizes the issuance of the 2024 General Obligation Bonds. The resolution also amends the tax levy requirements needed for the repayment of the bonds.

6.c Cemetery Rules

 

Resolution adopting regulations governing the operation of Oakland Cemetery including lot owner rights, maintenance practices, and visitor rules and rescinding Resolution No. 24-22.

Comment:

The City Code provides regulations governing the operation of Oakland Cemetery shall be established by resolution of the City Council. When Council updated the regulations in early 2024, no provisions addressed cremation monuments (a monument which is hollow to allow placement of an urn).  This resolution amends the the regulations to add provisions for cremation monuments, and there are no other substantive changes.

6.d Cemetery Fees

 

Resolution establishing a schedule of rates and charges for Oakland Cemetery and rescinding Resolution No. 24-23.

Comment:

The City Code provides rates and charges for services and burial spaces for Oakland Cemetery shall be established by resolution of the City Council. When Council updated the rates and charges in early 2024, rates for cremation monuments (a monument which is hollow to allow placement of an urn) were not included.  This resolution amends the rate schedule to add a rate for cremation monuments, and there are no other changes to rates and charges.

6.e Block Party & Oktoberfest alcohol agreement

 

Resolution approving an agreement with the Downtown District to allow the sale and possession of beer and wine during the Block Party and Oktoberfest.

Comment:

The City Code allows private entities by agreement to sell and their customers to consume and possess alcohol on public right-of-way under limited circumstances. The Downtown District would like to be able to sell beer and wine in demarcated areas during the Block Party on June 22 and Oktoberfest on Sept. 28 and customers to possess beer and wine.  This resolution approves the attached agreement, which is the same agreement as last year. The demarcated areas for the two events are shown on exhibits to the agreement.

6.f Riverside Festival Stage-alcohol agreement

 

Resolution approving an agreement with Riverside Theatre to allow the sale of wine and beer under limited circumstances in City Park.

Comment:

The City Code allows non-profit entities by agreement to sell and their patrons to consume and possess alcohol in a city park and on public right-of-way.  Riverside Theatre would like to be able to sell beer and wine during performances in June and July 2024 in a demarcated area in and around Riverside Festival Stage in City Park.  This resolution approves an agreement which is the same as last year.

6.g IRA Clean Energy Tax Credit Consulting Services Agreement

 

Resolution authorizing the City Manager to sign an agreement with Eide Bailly LLP to provide consulting services for the Inflation Reduction Act Clean Energy Tax Credit.

Comment:

This resolution will approve an agreement with Eide Bailly LLP to provide consulting services for the Inflation Reduction Act Clean Energy Tax Credit related to the Wastewater Digester Gas Improvements Project.  The total cost of the services are not to exceed $275,000, plus actual out-of-pocket expenses such as travel time, mileage, lodging and meals and funds are available in Account #V3184 - Wastewater Digester Gas Improvements.

6.h Sycamore Woods - Parts One and Three

 

Resolution accepting the work for the storm sewer, sanitary sewer, water main, paving, and certain sidewalk public improvements for Sycamore Woods – Parts One and Three, and declaring public improvements open for public access and use.

Comment:

This item will accept the sanitary sewer, storm sewer, water main and paving public improvements for Sycamore Woods – Parts One and Three, generally located east of the Sycamore Greenway and south of Whispering Meadow Drive.

6.i Hickory Hill Park Shelter and Restrooms Project

 

Resolution accepting the work for the Hickory Hill Park Shelter and Restrooms Project.

Comment:

The Hickory Hill Park Shelter and Restrooms Project has been completed by Rogers Construction, Inc., of Iowa City, Iowa, in substantial accordance with the plans and specifications.

 

Project Estimated Cost:  $442,000.00

Project Bid Received:     $424,696.25

Project Actual Cost:        $431,268.70

6.j Kirkwood Avenue CRANDIC Railroad Crossing Project

 

Resolution awarding contract and authorizing the Mayor to sign and the City Clerk to attest a contract for construction of the Kirkwood Avenue CRANDIC Railroad Crossing Project.

Comment:

This agenda item awards the Kirkwood Avenue CRANDIC Railroad Crossing Project Bridges Project.  Four (4) bids were submitted prior to the May 9, 2024 deadline.

Consent Calendar - Setting Public Hearings

 

7.a FY25 Utility Rates

 

Resolution setting a public hearing for June 4, 2024 on an ordinance amending Title 3, entitled "Finance, Taxation and Fees," Chapter 4, entitled "Schedule of Fees, Rates, Charges, Bonds, Fines and Penalties" of the City Code to increase or change charges and fees.

Comment:

Title 3, Chapter 4 amendments includes changing the low income discount for water and wastewater users charges from 60 percent to 75 percent of the minimum monthly charge and for stormwater utility fee from 60 percent to 75 percent of the monthly charge and updating Section 5 "Solid Waste Disposal" to match the language in Section 3 "Potable Water Use and Service" on the 10 percent delinquency charge that was approved in October 2020.  It was inadvertently changed back to 5 percent with the utility rate changes set to be approved May 21, 2024.

7.b 2024 Water Pavement Patching Project

 

Resolution setting a public hearing on June 4, 2024 on project manual and estimate of cost for the construction of the 2024 Water Pavement Patching Project, directing City Clerk to publish notice of said hearing, and directing the City Engineer to place said project manual on file for public inspection.

Comment:

This project includes pavement repairs associated with water main breaks on various streets throughout Iowa City. The estimated construction cost is $320,000.00 available in the Water Division Operating Budget, account #73730130.

Public comment is intended so that members of the public may be heard by Council. Because Community Comment is for items not properly noticed on the agenda, Council cannot engage in discussion or debate due to open meetings laws.

 

Only in-person comments will be allowed for Community Comment.  Public comment for specific agenda items, which must be directly related to that agenda item, may be made in-person or remotely.

 

Individuals will be provided 3 minutes to speak. The Community Comment period will end at
7:00 p.m. unless an extension is needed to meet a minimum 30 minutes of total time allocated
for the Community Comment period.

 

The Mayor reserves the right to reduce the 3 minute period based on the number of

Ordinance rezoning property located at 302-316 E. Bloomington Street from Central Business Service (CB-2) zone to CB-2 with a Historic District Overlay (OHD/CB-2) zone. (REZ24-0001) (Pass & Adopt)

Comment:

At its meeting on February 8, the Historic Preservation Commission recommended approval of REZ24-0001 by a vote of 8-0. At its meeting on February 21, the Planning and Zoning Commission recommended approval of REZ24-0001 by a vote of 6-1 (Wade in the negative). The rezoning recognizes the property as an Iowa City Historic Landmark. Correspondence included in Council packet.

Comment:

This project includes asphalt overlay on Park Road and East Benton Street, as well as chip seal on Taft Avenue. The estimated construction cost is $1,350,000 available in the Annual Pavement Rehabilitation account, account #S3824.

Comment:

This item will approve the project manual and estimate of cost for the construction of the Landfill Equipment Building Replacement Construction Project.  This project includes construction of the new equipment building at the landfill.  The estimated construction cost is $4,650,000 and will be funded by the Landfill Fund through Account Number 3328.

10.c Fire Station 1 Apparatus Bay Slab Reconstruction Project

Comment:

This agenda item approves the project manual & estimate of the cost for the construction of the Fire Station 1 Apparatus Bay Slab Reconstruction Project. The project includes replacing the front half of the slab with structural concrete, installing new floor drains and a code required sand/oil separator with connection to the sanitary system and associated exterior pavement replacement. The estimated cost of construction is $300,000 and funds are available in the Fire Station 1 Apparatus Bay Slab Reconstruction account #Z4409 and in the City's Storm Water Fund.

10.d FY25 Utility and Parking Rates Public Hearing

 

Ordinance Amending Title 3, Entitled "Finances, Taxation And Fees," Chapter 4, Entitled "Schedule Of Fees, Rates, Charges, Bonds, Fines, And Penalties". (Pass & Adopt)

Comment:

Title 3, Chapter 4 amendments include a 3% increase in water users charges, a 5% increase in wastewater user charges, an increase in residential solid waste collection fees for curbside recycling fees by $1.00 per dwelling unit per month, an increase in the tipping fee charged at the landfill by $2.50 per ton, an increase in the hourly parking ramp fee by $1.00 per hour in the Court Street Transportation Center, Tower Place, Capital Street and Dubuque Street parking ramps, an increase in the hourly parking ramp fee by $1.25 per hour in the Chauncey Swan and Harrison Street ramps with the first hour free, an increase in the hourly parking meters from between $0.75 to $1.50 depending on the location and an increase in the fines for parking violations by varying amounts per violation in fiscal year 2025. 

10.e Adjusting Park Hours

 

Ordinance amending Title 10, entitled “Public Ways and Property,” Chapter 9, entitled “Parks and Recreation Regulations,” to adjust park closure hours. (First Consideration)

Comment:

Currently, all parks but Chauncy Swan, College Green, and Black Hawk Mini Park are closed from dusk to dawn. Under this ordinance  Chauncey Swan and College Green would be closed from midnight to dawn to continue to allow use later into the evening. When parks are closed, persons may still pass through when using trails and sidewalks. 

10.f Bicyclists in Crosswalks and Using Sidewalks

 

Ordinance amending Title 9, entitled “Motor Vehicles and Traffic,” Chapters 1 and Chapter 6 to require drivers to yield right of way to bicyclists at crosswalks and to require bicyclists riding on sidewalks to obey pedestrian devices at signaled intersections. (First Consideration)

Comment:

The Governor recently signed HF2568 requiring drivers to yield the right of way to bicyclists in cross walks, and this ordinance amends the City Code to be consistent with HF2568. This ordinance also requires a bicyclist riding on the sidewalk to obey pedestrian traffic control signals.

10.g City Park Pool - Selection of Conceptual Design A

 

Resolution selecting City Park Pool Conceptual Design A and authorizing the City Manager to enter into agreement with Williams Associates Architects, Ltd. to develop plans, specifications, bidding and construction services for the City Park Pool Replacement Project.

Comment:

This item selects Conceptual Design A and further authorizes City staff to pursue variations that further the previously established goals of the project outlined in the May 7, 2024 City Council Work Session and keep the project in line with the $18.39 preliminary cost estimate. Such design variations may include, but are not limited to, detaching the connected pools, enhancing 25 meter and/or 50 meter lap swimming options beyond what is illustrated, replacing the current channel with other recreational features for young swimmers, adjusting pool deck size and accommodations, and making bathhouse and filter building modifications. Correspondence included in Council packet.
